WINDOW ROCK – Today’s hearing with the Special Prosecutor concluded without a ruling, and the matter remains under consideration.

From the beginning, the President has welcomed a fair and independent investigation—free of politics and conducted the right way under Navajo law.

In court, the President made clear that this case suffers from fundamental legal flaws. The complaint was filed in the wrong forum, and the statute used to appoint the special prosecutor is invalid. These issues go directly to the integrity of the process.

This is not about avoiding scrutiny. It is about ensuring that any review is conducted lawfully, fairly, and without political influence. When the process is flawed, it opens the door to politicization—and that is exactly what we are seeing.

Navajo law makes clear that this case should be dismissed; the Navajo Nation Council’s 2010 rewrite of the Special Prosecutor Act relied on a false emergency and unlawfully claimed executive powers in violation of Fundamental Law and the 1989 Title 2 Amendments, rendering the current special prosecutor’s appointment invalid.

If there are allegations to be examined, the appropriate path is clear – they should be handled through the correct process via proper legal channels, including the Department of Justice.

The President will continue to advocate for a process that is fair, lawful, and free of politics.
