WINDOW ROCK, Ariz. — After reviewing the applicable statutes, the Special Division of the Window Rock District Court concluded that it lacks jurisdiction to hear the ethics complaint filed against Navajo Nation President Buu Nygren by Special Prosecutor Kyle Nayback.

In response to the Dec. 5, 2025 ruling, President Nygren stated, “I want to thank the Special Division of the Window Rock District Court for performing a careful and thorough legal analysis. I respect the court’s decision, and I expect Speaker Curley and the rest of the Council to do the same.”

The court determined on December 5 that under Navajo Nation law, judges of the Special Division are prohibited from participating in judicial proceedings involving a Special Prosecutor appointed by that Division.

The issue arose from the Special Division’s prior appointment of a Special Prosecutor pursuant to an application submitted by the Navajo Nation Council’s Office of Legislative Counsel on August 8, 2025, under WR-SD-01-25.

The Special Division further clarified that its statutory responsibilities are limited to appointing a Special Prosecutor when a conflict of interest exists, recommending and contracting appropriate compensation, and defining or modifying the scope of the Special Prosecutor’s jurisdiction.

Based on these findings, the ethics complaint was dismissed for lack of jurisdiction.

“This decision needs to put an end to what has become a political witch hunt,” President Nygren added. “It is time for all branches of government to move past these distractions and refocus our efforts and work on serving the Navajo people.”
